The Government of Canada has tabled new legislation related to Medical Assistance in Dying (MAID), barring people suffering solely from a mental illness from accessing the controversial health service, while also allowing for advance requests for those eligible.
Justice Minister Sean Fraser and Heath Minister Marjorie Michel detailed Bill C-41 – the ‘Medical Assistance in Dying Safeguard Act’ – at a Tuesday press conference. The legislation would amend the Criminal Code to shield doctors from prosecution when they provide assisted death to an eligible patient who requested it in an advance directive.
While the bill may be able to amend the Criminal Code, the provinces and territories will “organize, regulate, and deliver health care, including MAID assessments and provision,” the federal government said.
“We will work with provinces and territories on implementation, with rigorous safeguards to protect people and ensure the decision remains voluntary and free from external pressure,” Fraser said of the bill, adding, “Everything you do in the space of medical systems and dying is controversial. People hold very different views.”
The proposed bill will need to pass the House of Commons and the Senate before March 17 — the date on which the law states people with a mental illness as their sole underlying condition would become eligible for MAID. Fraser emphasized the “extraordinarily serious” consequences of not meeting this deadline to his fellow Parliamentarians.
